This question was also examined by the Supreme Court in State of Bihar vs. D.N. Ganguly (supra). In that case the Government had referred an industrial dispute to the Tribunal but later on the previous order was revoked by it. In this connection while discussing the scope of Section 21 of the General Clauses Act, their Lordships of the Supreme court laid down:-

In Nava Samaj Ltd. vs. Registrar of Companies (2) the provisions of Sections 14 and 21 of the General Clauses Act came up for consideration before the Bombay High Court and Desai J. after considering the observations of their Lordships of the Supreme Court in Stale of Bihar vs. D.N. Ganguly (3), observed that the questions to be examined in all cases must be to find out whether the scheme and object of the relevant provision of law where under the powers and conferred to an authority are repugnant to the rule of construction as contained in Sections 14 and 21 of the General Clauses Act.
