Learned counsel for the applicant further submitted that if the questioned vehicle is kept at the police station, for want of proper maintenance, it will be damaged and if not used will cause loss to the petitioner. Placing reliance on Sunderbhai Ambalal Desai Vs. State of Gujarat (AIR 2003 SC 638), the Apex Court has held, Powers under Section 451 should be exercised expeditiously and judiciously - Court to pass appropriate orders immediately and articles are not to be kept for a long time at police station, in any case, for not more than 15 days to one month - Procedure for disposal of seized valuable articles and currency notes vehicles, seized liquor and Narcotic drugs suggested, and therefore prayed that the questioned vehicle be entrusted to the interim custody of the petitioner.
