8. For the reasons aforesaid, I am of the view that Rule 37-B has no application to the product in question. It is pertinent to note that this very product manufactured by this very company was considered in the context of Rule 37-B by the Orissa High Court in the case of Nestle India Ltd. Vs. A.K. Chand, reported at 1995 Cri. L.J. 3053.
