43. Considering the aforesaid propositions, it is clear that
there is nothing in the complaint that there is evidence either in
the initial complaint or in the depositions of the mother or the
sister of the deceased that she was made subject to the cruelty or
harassment in connection with the demand of dowry soon before
her death. The mother has stated in her initial complaint that the

demand of the transfer of the flat was made ten months before
the death. Hence, the demand was made long time before the
death. Though the time period is not material to decide if the
same was soon before the death but at the same time there is
nothing also on the record if the said demand carried on with the
passage of time and played a role in the suicide of the deceased.
Hence, the court is not hesitant to hold there is no sufficient
material for the offence under section 304B IPC on the record.
