15. Learned counsel for the petitioner mainly relied upon
State of Uttranchal vs. Rajesh Kumar Gupta, 2007 (1) SCC 355.
The matter before the Hon'ble Supreme Court arose out of the
grant of bail to the accused person who was a Ayurveda Acharya,
running two clinics. The appellant in that case is stated to be
assisted by eight other medical practitioners being Allopathic
Ayurvedic doctors. The drugs recovered from the appellant were
allopathic mentioned in Schedule 'G' and 'H' of the Drugs and
Cosmetics Act were indisputably used for medicinal purposes. It
was held that once the the drugs are said to be used for medicinal
purposes, it cannot be denied that they are acknowledged to be
the drugs which would come within the purview of description of
the expression medicinal purposes.
