Union Of India vs Popular Construction Co on 5 October, 2001
In Union of India v. Popular Construction Co. , the issue was whether the provisions of Sections 4 to 24 of the Limitation Act would apply to a petition filed under Section 34 of the Arbitration and Conciliation Act, 1996. The challenge to an arbitration award under Section 34 is before a "Civil Court". The Supreme Court observed as under:

23. Is the Tribunal constituted under the Act a court for the purposes of applicability of the provisions of the Limitation Act? This issue, in our opinion, stands concluded by the judgment of this Court in so far as the Act is concerned in Mehta Construction Company v. State of Maharashtra [1981] 48 STC 398 (Bom) which followed the judgment of the Supreme Court in Nityanand M. Joshi .
