In this view of the matter, we are of the
view that the view of the Punjab and Haryana High
Court [Union of India v. Tarsem Singh, 2018 SCC
OnLine P&H 6036], [Jang Bahadur v. Union of
India, 2018 SCC OnLine P&H 6034], [Union of
India v. Abhinav Cotspin Ltd., 2016 SCC OnLine
P&H 19319] is correct, whereas the view of the
Rajasthan High Court [Banshilal Samariya v. Union
of India, 2005 SCC OnLine Raj 572 : 2005-06 Supp
RLW 559] is not correct."
