11. Further, the case of Hindustan Construction Company Ltd. (supra)
relied upon by learned counsel for appellant is clearly distinguishable as it
was disposed of purely on the basis of the terms of bank guarantee therein. It
was held that invocation was bad because it was invoked by a wrong person
and the bank guarantee in the said case was not unconditional or
unequivocal.
