S.R. Bommai And Others Etc. Etc. vs Union Of India And Others Etc. Etc. on 11 March, 1994

In addition to this, the employees who were complaining that proper vacancies were not reported 29 OA No.429/2019 had filed OA bearing No.249/2014 (Lionel A. D'souza & 2 Ors. Vs Union of India & Ors.). In that OA, the respondents i.e. the Department had taken a stand that 45 vacancies were correctly reported. Thus the stand taken by the respondents in that OA is diagonally opposite of the stand taken in this OA. Moreover, this OA.No.249/2014 has been dismissed by this Tribunal which means that the vacancies as contended by the applicants were held not be correct. In this view of the matter, we find that the order of the Disciplinary Authority is perverse and needs interference.
