(i).The present suit has been filed by the Executive Officer of
Sankara Narayasamy Devasthanam. No documents whatsoever has been
filed to indicate that the Executive Officer has obtained the prior
permission of the Commissioner of HR & CE Department before filing
the present suit. According to the learned Senior Counsel, it is only the
Board Trustees who are competent to initiate legal proceedings. The

learned Senior Counsel relied upon a Division Bench judgment of our
High Court reported in 2003-1-LW 386 ( Sri Arthanareeswarar of
Tiruchengode and others Vs. T.M.Muthuswamy Padayachi and
others) to contend that the suit has been filed by the Executive Officer
without any permission from the Commissioner, HR & CE Department
and the same is not maintainable. He had further contended that the said
plea with regard to the maintainability of the suit has been raised in
Paragraph No.12 of the written statement filed by the first defendant.
