In this regard it significant to mention the decision of Hon'ble Constitution bench
of the Supreme Court in civil appeal No. 35953612/1999 (Circulated under DOPT
OM No. 49019/1/2006-Estt (C) dated 11/12/2006) in the case of Secretary State of
Karnataka and Ors. Vs. Uma Devi and others, in which it has been reiterated that
any public appointment has to be in terms of the Constitutional scheme. ESIC,
being a statutory body formed under provisions of ESI Act 1948, is duty bound to
recruit its employees by following the norms laid down for public employment.
