10. Mr. Patil, learned counsel for the appellant placed reliance on the decision of the Supreme Court in the case of Ganesh Bhavan Patil & Anr. Vs. In the present case, as stated earlier, there is delay of almost 15 days in recording the statement of the witness. No explanation has been given for the delay in recording the statement. In addition, the conduct of this witness is also found unnatural in as much as from the date of the incident i.e 6.5.2012 till 21.5.2012, he did not narrate the incident to any person. In addition, after the death of Zahir, he did not go to the house of Zahir though he was related to Zahir. All these facts go to show that he is a got up witness.
