"11. We have heard the learned counsel for the
parties and carefully perused the record. It is not

in dispute that as on 10-3-2005 all the appellants
had completed more than 10 years' engagement.
It is also not in dispute that due to non-
constitution of the Staff Selection Board and non-
holding of examination, the appellants could not
apply for regular selection. As on date, the
appellants have completed 19 to 24 years'
service. Therefore, the ratio of the judgment in
State of Karnataka v. Umadevi (3) cannot be
invoked for denying them the benefit of policy
contained in GR dated 10-3-2005."

9. Learned counsel for respondents further averred that
the contractual employees cannot claim regularization in
absence of any scheme or any process which has
categorically been stated by Hon'ble Apex Court in State of
Punjab Vs Jagjit Singh. It is specifically averred by the
Hon'ble Apex Court that „Once there are vacancies in
sanctioned posts such vacancies cannot be filled in except
without regular recruitment process, and thus neither the
court nor the executive can frame a scheme to absorb or

regularize persons appointed to such posts without
following the regular recruitment process‟.
