In this regard the judgment of this court in the case of Jabar Singh (supra) and Full Bench judgment of this Court in Krishan Kumar's case (supra), shall be applicable. Therefore, the failure of the plaintiff-respondent to make up the deficiency of the court fee would necessarily result into affirming the conclusion that the plaintiff-respondent is not interested in payment of the court fee. Therefore, his suit is liable to be dismissed. Consequently, the judgment of the lower Appellate Court is liable to set aside.
