(supra) is wholly distinguishable as in that case the issue of breach of trust/ loss of confidence had been pleaded in the context of finding of guilt returned and sustained. Once the finding of guilt has been reversed by the appellate authority, the plea of loss of confidence or breach of trust would never arise.
