Magistrate belatedly. Considering the aforesaid facts, the
learned Sessions Judge has rightly relied upon the decision in
the case of Mehraj Singh v. State of U.P., reported in
(1994) 5 SCC 188. Since other witnesses having no personal
knowledge, no further discussion is required. The evidence of
the said witnesses is not helpful to the prosecution case. Mere
recovery of the weapon is not sufficient to hold the accused
persons guilty.
