Singh Saini vs. High Court of Delhi (supra)
while dealing with the provisions of Order 39 (2)(a) of the Civil
Procedure Code, it has been held that once a suit is finally
disposed of, the interim order, if any, merges into final order.
It was further held that if the case is, ultimately, dismissed, the
interim orders were stand nullified automatically. In the present
case, when there is no implementation of the interim order and
when the petition is dismissed without any adjudication with regard
to the issue involved in the matter, I am of the opinion that
the interim order merges with the final order.
