Since the Division Bench of this Court in the case of Sumit and Another (supra) has overruled the Single Bench decision of this Court in the case of Moti Singh Sikarwar (supra), therefore, Section 195 (1) (a) (i) Cr.P.C. is applicable for taking cognizance of offence under Section 174-A I.P.C. and a Court cannot take cognizance of an offence under Section 174-A I.P.C. on the basis of charge-sheet filed after investigation.
