20. Relying upon the decision in Mandvi Co-
operative Bank's case referred to supra, the Co-ordinate
Bench of this Court, in Malenadu Areca Traders' case
referred to supra, set aside the judgment and order of the
trial Court mainly on the ground that it erred in permitting
accused to lead defence evidence by way of affidavit and
remanded the case for fresh disposal, to enable the
accused to lead oral evidence, if he so desires.
