4. The learned counsel for the petitioner placed reliance on
the judgment of Hon'ble Supreme Court in State of Gujarat
and others Etc., Vs Jayeshbhai Kanjibhai Kalathiya Etc.1,
wherein it is held that State Governments cannot restrict the
movement of transportation of sand from one State to another
State, which is contrary to Article 301 of the Constitution of
India. On the other hand, the learned Government Pleader
vehemently opposed the Writ Petition stating that, in view of
the ban imposed as per Rule 9-P of 1966 Rules, the petitioner
cannot be permitted to transport sand beyond the border of
the State.
