13. At this juncture, the learned counsel for the petitioner has relied on the following judgment in COUNCIL OF SCIENTIFIC AND INDUSTRIAL RESEARH AND ANOTHER VS. K.G.S. BHATT AND ANOTHER reported in AIR 1989 SC 1972. In that case, the respondent therein was granted a benefit of promotion by the Administrative Tribunal and the same was questioned before the Apex Court. The Apex Court held that since the respondent therein did not have any avenue of promotion, the Apex Court was not inclined to interfere with the matter.
