Further reliance is placed by learned senior Counsel for the
petitioner in Full Bench decision of this Court in the case of
State of M.P. and another vs. Mahendra Kumar Saraf,
[2005(3) MPLJ 578] contending inter alia that the
requirement is that signing the proposal has to be verified
by the Collector as the State Government is nothing but
required to forward the proposal to the State Election
Commission like a Postoffice after its receipt from the
Collector.

41. This Court in Siraj Ahmad Siddiqui v. Prem
Nath Kapoor while dealing with the provisions of
the U.P. Urban Buildings (Regulation of Letting, Rent
& Eviction) Act, 1972, referring to the concept of
first hearing, held as under : (SCC p.412, para 13)
"13. The date of first hearing of a suit under
the Code is ordinarily understood to be the
date on which the court proposes to apply its
mind to the contentions in the pleadings of the
parties to the suit and in the documents filed
by them for the purpose of framing the issues
to be decided in the suit. .................We are of
the view, therefore, that the date of first
hearing as defined in the said Act is the date
on which the court proposes to apply its mind
to determine the points in controversy
between the parties to the suit and to frame
issues, if necessary."
