8. It is settled principle law that any evidence
thereafter is led which is not based on material
propositions has to be eschewed. If any authority is
required, reference could be made to the decision of the
Apex Court reported in AIR 2008 SC 2033 (ANATHULLA
SUDHAKAR .vs. BUCHI REDDY (DEAD) BY L.R.S &
OTHERS), dealing with a situation like this where without
material propositions before courts below grounds were
urged in the appeal. The Apex Court has held specifically
in paragraphs 8 and 9 as follows:
Section 166 in The Motor Vehicles Act, 1988 [Entire Act]
Section 145 in The Indian Evidence Act, 1872 [Entire Act]
