It is argued by the learned counsel for the applicant that from the applicant 120 ampule 2 ml. each of Buprenorphine Injection Talgesic have been recovered along with 200 ampule 2 ml. each of Diazepam injections. Thus, in 120 injections the quantity of Buprenorphine is 240 ml. As per the Act, the commercial quantity of Buprenorphine is 20 gm. while from the applicant only 240 ml. Buprenorphine is said to have been recovered. So far as quantity of Diazepam injection is concerned, it is 400 ml. While as per the Act, the minimum quantity of Diazepam is 20 gm. and its commercial quantity is 500 gm. Thus, by placing the judgment of Binu Vs. Union of India(Kerala), 2011(2)KHC 817, it is submitted by the learned counsel for the applicant that the quantity of Buprenorphine and Diazepam alleged to be recovered from the applicant is below to the commercial quantity. The applicant is languishing in jail since 4.4.2023, hence, the prayer for bail is made.
