Smt. Shanti Sharma & Ors vs Smt. Ved Prabha & Ors on 26 August, 1987

On the death of his father, petitioner claims to have occupied the tenanted premises. He does not claim title to the said property. His rights are derived from his father. The Supreme Court in the case of Shanti Sharma and Ors. vs. Ved Prabha and Ors., AIR 1987 SC 2028 noted that the ownership is not to be understood as absolute ownership but only a title better than the tenant.
