In support of his contention, learned counsel for the appellants also relied on two judgments of Apex Court in 'Shiva Karam Payaswasmi Tewari vs. State of Maharashtra' (2009) 11 SCC 262 and 'Manphool Singh and others vs. State of Haryana' 2019 (106) ACC 284. The said two cases cited and relied upon by learned counsel for the appellants cannot be made applicable to the present case as the same are distinguished from the facts and circumstances of the present cast.
