11. Similarly, the Court finds that, broadly and
substantially, the facts of Bhola Yadav (supra) are similar to the
facts of the present case and in essence the reasoning in Bhola
Yadav (supra) would also apply to the facts of the present case.

10. The Court is also in agreement with the contention
