In this regard
case of the accused is well covered by Vijay Singh v. State and
ors. Crl. Appeal No.819/12 decided on 030912. In the cited
case, Hon'ble High Court of Delhi did not rely upon the pointing out
memo holding that it was not admissible in evidence as it did not fall
within the scope and ambit of section 27 of Indian Evidence Act 1872
because the place of occurrence was already known to the police.
Hence, pointing out memos are not incriminating circumstance
against any of the accused.
