10. So far as the Judgment of the Hon'ble Supreme
Court in India Carat Pvt. Ltd. (Supra) is concerned, there
is no dispute about the legal procedure laid down therein.
However, it cannot be said that the procedure adopted by
the Ld. Trial Court was wrong. In this Judgment, the
Hon'ble Supreme Court laid down that even after
acceptance of final report, the Magistrate can take
cognizance of the case and summon the accused.
