State Of Rajasthan vs Smt. Kalki & Anr on 15 April, 1981
on behalf of the appellant that prosecution witnesses are highly
interested and on this ground appeal filed by appellant be
accepted is also rejected being devoid of any force for the
reasons mentioned hereinafter. We are of the opinion that in
sexual assault cases generally the prosecutrix used to narrate
the incident to her mother and relatives. It was held in case
reported in AIR 1981 SC 1390 titled State of Rajasthan vs. Smt. Kalki
and another that relative witness is not equivalent to interested
witness. It is well settled law that conviction could be based on
honest and trustworthy evidence even of a single witness in
criminal case.
