29.In so far as the aspect of the vehicle being driven by the
accused is concerned, Ld. Counsel has challenged the
prosecution stating that the accused was not driving the
vehicle when the accident took place. He had parked his
vehicle on the petrol pump to get it refueled. It was the
deceased who was drunk and he himself caused the accident
which resulted in his death and the fact that accused was
