In State of West Bengal v. Sankar Ghosh1 the Hon'ble Supreme Court held that, 'the standard of proof required in a criminal case and the standard of proof required to establish a charge in the departmental enquiry are different and that the mere fact that the employee was acquitted or discharged in a criminal case by itself cannot be a ground to hold that the employee is not guilty of the charges in the departmental enquiry.'
