The Supreme Court in the case of Prem Shankar Shukla v. Delhi Ad
ministration, and in the case of Sunil Batra v. Delhi Administration and
Ors., AIR 1978 SC 1675, 1978 CriLJ 1741, ( 1978 ) 4 SCC 494, [ 1979 ] 1 SCR 392, have laid down the guidelines and issued directions regarding
handcuffing of undertrials and convicts. But in the instant case no
guidelines referred to in the above said judgment are followed. There
fore, I am of the considered view that respondent 6 has virtually interfered with the liberty of the petitioners and thereby caused damage to
their reputation in handcuffing and parading in the open streets. There
fore, I am of the considered view that it is a fit case to award compensation in favour of the petitioners.
