46. It is a well-settled principle of law laid down
by the Hon'ble Supreme Court in National Insurance
Co. Ltd. v. Swaran Singh & Ors., (2004) 3 SCC 297,
that even in case involving breach of policy condition
such as the vehicle being driven without a valid and
effective driving licence the doctrine of pay and
recovery applies. In accordance with this principle the
tribunal is empower to direct the insurer to satisfy
award in the first instance and thereafter recover the
amount from the owner of the offending vehicle.
