the Constitution of India, in view of the observations of the Hon'ble Apex
Court in City and Industrial Development Corporation Vs. Dosu
Aardeshir Bhiwandiwala 2009 (1) SCC 168 wherein it has been held as
under:

9. Further, the Hon'ble Apex Court in United Bank of India Vs.
Satyawati Tondon & others 2010 AIR (SC) 3413 has held that ordinarily
the High Court should not exercise its discretion where there is alternative
remedy available under the SARFAESI Act. The relevant observation reads
