7. Mr.Prabhu Rajadurai however points out that the award of Ph.D.,
would have be to in compliance of the UGC (Minimum Qualifications for
Appointment and Career Advancement of Teachers in Universities in Colleges)
Regulations, 2009 so as to be eligible for such exemption. According to him,
the Ph.D., awarded to the appellant is not in compliance with the aforesaid
Regulations and hence, even on that score, the petitioner is disentitled to
her claim. We are of the view that the argument of Mr.Mohanlal is liable to
be rejected even without reference to the aforesaid contention of
Mr.Rajadurai in the light of the categoric pronouncement of the Supreme Court
in the case of P.Susheela (supra).
