In the light of the judgment of the Allahabad High Court referred to above, it cannot be held that the lower Court was right in dismissing the suit on the basis of the opinion of the expert under Ex.C1. Hence, the finding of the Court below that the suit is barred by limitation has to be set aside and is accordingly set aside. The matter is remitted back to the Court below to hear the same afresh. The Court below shall dispose of the suit within a period of six months from the date of receipt of copy of the order.
