"A proper compliance with the requirements of Article 166 of the Constitution gives immunity to the order in the sense that it cannot be challenged in the court of law on the ground that it is not an order of the Governor. If the requirements of the said article are not complied with, the resulting immunity cannot be claimed by the State but that by itself does not nullify the order if it appears from other material that such a decision in fact was taken by the Government (See Dattatraya Moreshwar v. State of Bombay AIR 1952 SC 181). The learned Government advocate placed before us the original file of the appeal which clearly shows that the said order had been made by the Minister of State (Home) who had jurisdiction to pass the orders challenged before us."
