This is what has been said in Hajari Lal Sahu (Supra) and Aniruddha Kumar (Supra) with which also this Court is in entire agreement. The decision of the Apex Court referred to by the respondents No. 2 and 3 in the orders, impugned in this writ petition, that immediate potential user of the land is relevant for the purpose of determining market value, cannot be disputed but that is one of the relevant consideration and can not be the sole basis for holding that the value of the property as set forth in the instrument is not correct and it must be higher than that.
