In a recent decision, the Apex Court in Maheshwar Tigga vs State of Jharkhand reported in (2020) 10 SCC 108 has held that the circumstances not put to an accused under Section 313 Cr.P.C cannot be used against him and must be excluded from consideration. Considering the importance of putting all relevant questions to the accused under Section 313 Cr.P.C., it was held therein to be an essential part of fair trial, basic to the principles of natural justice.
