(h) From the aforesaid discussion, it is clear that in Mahavir
Spinning Miles case the issue was in regard to continue breach
of contract whereas in the instant case there is no contract and
further there is no continuing wrong as the plaintiff claimed that
due to unauthorized and illegal construction on the second
floor of suit property by defendants the premises belonging to
him suffered deep seepage which was damaged his property.

(c) It is admitted fact that plaintiff filed suit for mandatory
and permanent injunction against defendants and MCD titled
as Satya Parakash Aggarwal vs. MCD & ors. It is not disputed
that the said suit was dismissed by Ld. Addl. Sr. Civil Judge vide
order dated 06.09.2011. Plaintiff placed on record the certified
copy of that suit Ex. PW1/5 wherein plaintiff vide para 9 stated
