In the
case of CCE, Kanpur v. Agra Leather Goods (P) Ltd, 2000 (39) RLT
674, the Tribunal, relying upon the decision in the case of Union
Quality Plastics (P) Ltd v. CCE, Surat, l999 (35) RLT 339, held that the
benefit of SSI "Notification could not be disallowed for the simple
reason that the Revenue Department suspected the correctness of the
investment disclosed by the assessee in the plant and machinery,
while getting the registration."
