Payrelal). If the accused is proved to have discharged the
initial onus of proof placed on him by showing that the
existence of consideration was improbable or doubtful or
illegal, then the onus will shift back to the complainant who will
then be under an obligation to prove it as matter of fact and
failure to do so will dis-entitle him to any relief on the basis of
the negotiable instrument."
