In the decision rendered by the Hon'ble Superme Court in Bala
Shankar Bhattjee and others Vs. Charity Commissioner Gujarat State
(AIR 1995 SC 1967), it was held that the Gazetteer of the Bombay
Presidency Volume III published in 1879 is admissible under Section 35
read with Section 81 of the Evidence Act 1872. The Gazetteer is admissible
being official record evidencing public affairs and the court may presume

their contents as genuine. The statement contained therein can be taken into
account to discover the historical material contained therein and the facts
stated therein is evidence under Section 45 and the court may in conjunction
with other evidence and circumstances take into consideration in adjudging
the dispute in question though may not be treated as conclusive evidence.
In the said decision Hon'ble Supreme Court also relied on, as supporting
evidence, historical statements of historians and the passages in the
historical books.
