Iridium India Telecom Ltd vs Motorola Incorporated & Ors on 20 October, 2010

In the case of "Iridium India -5- Telecom Ltd. Vs. Motorola Incorporated and Others" (supra), it was held that deception must necessarily produce inducement to part with or deliver property which the complainant would not have parted with or delivered, but for inducement resulting from the deception. While relying upon the aforesaid judgment, learned counsel for the opposite party no. 2 has submitted that there was inducement on the part of the petitioner which resulted at the initial stage in entering into a partnership business and thereafter on his inducement loan was given, but the same was never returned and therefore it can be held to be a deception on the part of the petitioner leading to breach of trust which the opposite party no. 2 had put on the petitioner.
