In Rini Johar's case (supra), the Hon'ble Supreme Court,
relying upon the aforesaid judgment of Arnesh Kumar (supra), quashed the
FIR registered against the accused persons. It is also held by the Hon'ble
Supreme Court that the arrest of the accused persons was not done by
following the procedure under Sections 41 and 41-A of Cr.P.C. Counsel for
the petitioners has further submitted that from a bare perusal of the FIR, no
offence under Section 66 of the Information Technology Act is made out.
