2. We have heard Mr. Pakale, learned advocate for the
respondent no.1 in Writ Petition No. 538 of 2005. He has
cited the decisions of the Supreme Court reported in AIR
1966 SC 385 (Jan Mohammad Noor Mohamad Bagban
vs. State of Gujarat) and (2007) 13 SCC 116 (Veneet
Agrawal vs. Union of India and Ors.) in support of the
contention that 'laying' as envisaged in section 28(2) of the
Maharashtra Mathadi Hamal and Other Manual Workers
(Regulations of Employment and Welfare) Act, 1969 is not
mandatory.
