Thus, the
decision of the Hon'ble Supreme Court in the case of Children
Book Trust (supra) has no application to the instant case
under Sections 11 & 12 of the Act primarily for the reason that
the provisions under which the aforesaid judgement was
rendered by the Hon'ble Supreme Court are not parimateria to
the provisions relating to Sections 11 & 12 of the Act, apart
from the Scheme of the Act being different. Thus, the second
reason taken by the Commissioner is unfounded and cannot
be upheld.
