15. Though the earlier view of this Court in Ram Naths case (Ram Nath Madhoprasad v. State of Madhya Pradesh stands overruled by a five-Judge judgment in the case of Tarachand Damu Sutar v. State of Maharashtra but there is no denial of the fact that a dying declaration ought to be treated with care and caution since the maker of the statement cannot be subjected to any cross- examination.
