15. The Supreme Court in L. Rajaiah v. Inspector General of Registration and Stamps, Hyderabad and Ors. , considered the case of denial of promotion on the ground of punishment of stoppage of increment and at Paragraph 4, held as follows:

16. The issue as to whether, withholding of promotion due to punishment would amount to double jeopardy, is no more res integra, as the same has been considered by the Supreme Court in Union of India v. K.V. Jankiraman , at Paragraphs 28 and 29, the Supreme Court held that,

We respectfully follow the said decision. It has been clearly pointed out there that the, denial of promotion would not amount to penalty and that it would be open to the authorities to take into account the fact that some punishments were imposed on them during the relevant period.
